We are pleased about your visit to our website and your interest in our company.

The protection of your personal data during collection, processing, and use on the occasion of your visit to our website is an important concern for us and takes place within the framework of legal regulations.

Below we explain which information we collect during your visit to our website and how it is used:

1. Collection and storage of personal data as well as type and purpose of their use

a) Visiting theb website

Whenever a customer (or other visitor) accesses our website, the internet browser used on your device (computer, laptop, tablet, smartphone, etc.) automatically sends information to the server of our website. This information is temporarily stored in a so-called logfile.

The following data is collected without your intervention and stored until automated deletion:

• (pseudonymized) IP address of the requesting computer, as well as device ID or unique device identifier and device type,
• name of the retrieved file and amount of data transferred, as well as date and time of access,
• report on successful retrieval,
• requesting domain,
• description of the type of internet browser used and, if applicable, the operating system of your device as well as the name of your access provider,
• your browser history data as well as your standard weblog information,
• location data, including location data from your mobile device. Please note that most mobile devices allow you to control or disable the use of location services in the device’s settings menu.

Our legitimate interest pursuant to Art. 6 (1) sentence 1 lit. f GDPR in collecting this data is based on the following purposes:

ensuring a smooth connection setup and convenient use of the website, evaluating system security and stability, and for further administrative purposes.
Under no circumstances do we use the collected data for the purpose of drawing conclusions about your person.

b) Use of our contact form

For questions of any kind, we offer you the opportunity to contact us via a form provided on the website. At least a valid e-mail address and your name are required so that we know from whom the inquiry originates and to be able to answer it. Further information may be provided voluntarily.

The data processing for the purpose of contacting us is carried out pursuant to Art. 6 (1) sentence 1 lit. a GDPR on the basis of your voluntarily given consent.

The personal data collected by us for the use of the contact form will be automatically deleted after the request you have made has been completed.

c) Use of the job portal

In the application process, we offer the option of entering your contact details and uploading application documents via a form provided on the website.

Data processing for the purpose of the application is carried out pursuant to Art. 6 (1) sentence 1 lit. a GDPR on the basis of your voluntarily given consent.

The personal data collected by us for the application will be stored according to the Equal Treatment Act (GlBG) for a period of 6 months. If this results in an employment relationship, the data will be stored for the duration of the contractual relationship, provided that no statutory retention obligations conflict.

Data processing for the purpose of maintaining applicant records is carried out pursuant to Art. 6 (1) sentence 1 lit. a GDPR on the basis of your voluntarily given consent.

Data transfer within the corporate group for the purpose of the application is carried out pursuant to Art. 6 (1) sentence 1 lit. a GDPR on the basis of your voluntarily given consent.

2. Disclosure of personal data

Your data will not be transferred to third parties for purposes other than those listed below.

We only disclose your data to third parties if:

  • You have given your express consent to do so (Art. 6 (1) sentence 1 lit. a GDPR);

  • It is necessary for the processing of agreements with you (Art. 6 (1) sentence 1 lit. b GDPR);

  • There is a legal obligation for the disclosure (Art. 6 (1) sentence 1 lit. c GDPR);

  • The disclosure is necessary for the establishment, exercise, or defense of legal claims, and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data (Art. 6 (1) sentence 1 lit. f GDPR).

In these cases, the scope of the transmitted data is limited to the minimum required.

Third parties within the meaning of this privacy policy are, in particular, the distribution partners selected by us, insofar as they are used for the purpose of contacting you in connection with products and services from the vacapo® product environment, as follows:

3. Your rights
You have the rights to information, rectification, erasure, restriction, data portability, withdrawal, and objection.

If you believe that the processing of your data violates data protection law or that your data protection rights have otherwise been violated, you can lodge a complaint with our Data Protection Officer Mag. Melanie Böhm at datenschutz@besharp.at as well as with the national supervisory authority. In Austria, this is the Data Protection Authority.

4. Duration of data storage
The collected data will be stored with us as long as necessary to fulfill the purpose.

The retention period of the data applies until the revocation of the consent declaration, unless statutory retention obligations conflict.

5. Cookies
We use cookies on our website. These are small text files that your browser automatically creates and stores on your device when you visit our website. The cookie stores information related to the specific device you are using. However, this does not mean that we directly obtain knowledge of your identity.

These cookies are classified as so-called first-party cookies (set by our website) or third-party cookies (set by external providers). First-party cookies are set by the website you are currently visiting and are not accessible across domains by browsers. Third-party cookies, on the other hand, are set by providers other than the website you are currently visiting.

In addition, cookies are distinguished as technically necessary and technically non-necessary cookies. On our website, both technically necessary and technically non-necessary cookies are used as outlined below:

a) Technically necessary cookies

Technically necessary cookies are essential for the operation of our website and, for example, enable certain functions to be used in the first place. These session cookies, which are required only for the respective online session, are deleted automatically after you leave our website.

The legal basis for the use of technically necessary cookies is Art. 6 (1) sentence 1 lit. f GDPR.

b) Technically non-necessary cookies

Where you have provided consent, we also use technically non-necessary cookies on our website. These cookies primarily serve to analyze website usage and user behavior, compile reports on visitor activities, and provide other services associated with the use of our website.

Details on the functionality, duration, and potential third-party recipients of the data collected by these cookies are provided in our cookie banner. Where certain third-party providers set cookies in the course of delivering services for us, this is also specifically mentioned in our privacy policy.

The legal basis for the use of technically non-necessary cookies is Art. 6 (1) sentence 1 lit. a GDPR, provided you have given your consent.

You may withdraw your consent at any time. Furthermore, you may configure your browser at any time to manage the setting of cookies – for example, to be notified before a cookie is set or to completely block cookies.

6. Java Applets and Java Script

Java Applets and JavaScript may be used to provide our online services. If, for security reasons, you do not wish to use these tools or active content, you should disable the corresponding settings in your browser.

7. Clear Giffs
We, or certain third-party providers, may use a software technology known as Clear GIFs (also referred to as web beacons or web bugs) to help us improve our services by measuring their efficiency and performance. Clear GIFs are tiny graphics with a unique identifier and serve a function similar to cookies. Unlike cookies, which are stored on the user’s hard drive, Clear GIFs are invisibly embedded within our services.

8. Google
a. Google Tools

We use various Google tools on our website.

Google Analytics

With your consent, we use Google Analytics, a web analytics service provided by Google Ireland Limited (“Google”), on this website. We use the “Universal Analytics” mode, which makes it possible to assign data, sessions, and interactions across multiple devices to a pseudonymous user ID and thereby analyze a user’s activities across devices.

Google Analytics uses so-called “cookies,” which are text files stored on your computer that enable analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.
If IP anonymization is activated on this website, your IP address will first be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Please note that Google Analytics has been extended on this website with IP anonymization to ensure an anonymized collection of IP addresses (IP masking). The IP address transmitted by your browser within the framework of Google Analytics will not be merged with other Google data.

On behalf of the operator of this website, Google will use this information to evaluate your use of the website, compile reports on website activity, and provide other services related to website usage and internet usage.

Data sent by us and linked with cookies, user identifiers (e.g., user ID), or advertising IDs is automatically deleted after 14 months. Data for which the retention period has been reached is automatically deleted once a month.

You may withdraw your consent at any time with effect for the future by preventing the storage of cookies through a corresponding setting in your browser software. However, we would like to point out that, in this case, you may not be able to use all functions of this website to their full extent.

In addition, you can prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) by Google as well as the processing of this data by Google by downloading and installing the browser add-on available at:
www.tools.google.com/dlpage/gaoptout?hl=en
Opt-out cookies prevent the future collection of your data when visiting this website. To prevent collection by Universal Analytics across multiple devices, you must perform the opt-out on all systems used.

9. Social Media

We do not use social media plugins from social networks on our website, as these plugins usually result in every visitor to the website being immediately recorded by these services with their IP address. This also allows all subsequent online activities to be tracked, even if you do not click on any of the buttons.

For this reason, we have only integrated links to our profiles on the social networks listed below.

Please note that data of visitors to our website may also be processed outside the European Union. This may pose certain risks for users, as it could, for example, make it more difficult to enforce user rights.

Furthermore, user data may be processed by third-party providers for market research and advertising purposes. Based on user behavior and resulting interests, usage profiles may be created. These usage profiles can, in turn, be used to display advertisements inside and outside of social networks that are likely to match users’ interests.
For these purposes, cookies are usually stored on users’ devices, in which user behavior and interests are recorded. In addition, such usage profiles may also store data across different devices, particularly if users are members of the respective social network and are logged in there.

For a detailed description of the respective data processing activities, please refer to the information provided by the respective providers linked below. In the event of requests for information or to exercise your rights as a data subject, we would like to point out that the most effective way to assert such rights is directly with the social networks. Only they have direct access to their users’ data and can take appropriate action and provide information. Should you nevertheless require assistance, you are welcome to contact us.

We provide links on our website to the following social networks:
